User Agreement
This User Agreement ("Agreement") is a contract between you and BayTrade, Inc. ("Service Provider") and applies to your use of the BayTradeMall.com service and any related products and services available through www.BayTradeMall.com (collectively the "Service"). If you do not agree to be bound by the terms and conditions of this Agreement, please do not use or access our Services.
This Agreement applies to all countries.
You must read, agree with, and accept all of the terms and conditions contained in this Agreement and the Terms and Conditions before you may become a member of BayTradeMall.com.
Our StoreFronts are simply a venue to negotiate and complete transactions. Our Stores are not involved in the actual transaction between buyers and sellers. Accordingly, Service Provider has no control over the quality, safety or legality of the items listed, the truth or accuracy of the listings, the ability of sellers to sell items, or the ability of buyers to buy items. We cannot ensure that a buyer or seller will actually complete a transaction.
Legal Compliance
Items sold on the BayTradeMall.com site must adhere to all applicable laws. Our site and our services may be used only for lawful purposes and in a lawful manner. You shall comply with all applicable U.S. and international laws, statutes, ordinances, regulations, contracts and applicable licenses regarding your use of our Services.
Reservation of Rights
Service Provider retains the right to immediately halt any transaction, prevent or restrict access to our site or our services, or take any other action to restrict access to or availability of objectionable material, any inaccurate listing, any inappropriately categorized items, any unlawful items, or any items otherwise prohibited by the procedures and guidelines contained in our site. Service Provider retains the right to seek reimbursement from seller for any costs arising from seller's activity.
Spam
Under no circumstances may the BayTradeMall.com and/or StoreFronts be promoted by unsolicited email. An account of any Storefront owner who spams will be closed with no refund.
Fraud
You may not use or manipulate this service for any fraudulent activity or purpose.
Offensive Material
Service Provider reserves the right to determine the appropriateness of listings posted to our site.
Indemnification
You agree to indemnify Service Provider and its affiliates, employees, agents, representatives and third party service providers, and to defend and hold each of them harmless, from any and all claims and liabilities (including attorneys fees) which may arise from your submissions, from your unauthorized use of material obtained through the Service, or from your breach of this Agreement, or from any such acts through your use of the Service.
Editing Personally Identifiable Information
You may at any time review and change your personally identifiable information at BayTradeMall.com. This information includes but is not limited to your street address, city, state, zip code, country, daytime phone number, password. To change this information, the user must log on to My Account. You will not be able to change your email address as a security precaution.
Passwords
You may not disclose your password to any third party. If you lose control of your password, you may lose substantial control over your personally identifiable information. In addition, you may run the risk of another user accessing your password and using it to falsely represent your identity. If you have reason to believe that your password has been compromised for any reason, we strongly recommend that you immediately change your password.
Assignment
This Agreement and your user names and passwords are not assignable, transferable or sublicensable by you and any such conveyance will be null and void.
Information You Provide
To post messages on our message center or to use any of our other services we may require you to provide us with contact information, such as your name, street address, phone number, and email address.
Content Management
Service Provider reserves the right, but undertakes no duty, to review, edit, move or delete any material provided for display or placed on the Service or its bulletin boards, in its sole discretion, without notice.
Infringement
Service Provider respects copyright law and expects our account holders to do the same. We may terminate the accounts of users who infringe upon the copyright, or other intellectual property rights, of others.
Agency
You and Service Provider are independent contractors, and no agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship is intended or created by this Agreement.
Cookies
We also use cookies on certain pages of our site, and for services requiring registration. This is done primarily for your benefit as cookies allow you to log on only once per session. Most cookies are automatically deleted at the end of a session.
Information We Track
As you use our services, our servers will automatically track certain information about you in log files. This information includes your IP address, the URL that you just came from, which URL you go to next, which browser you are using, and which operating system you are using. These log files are not linked to your personal information.
